FAA Part 107 Requirements

State Drone Laws

Virginia regulates drone operations through a combination of criminal surveillance statutes, local government authority provisions, and law enforcement warrant requirements. Virginia Code § 18.2-260.2 makes it a Class 1 misdemeanor to use a drone to trespass and conduct surveillance of another person without consent, capturing images or video of individuals in private settings. Virginia Code § 19.2-60.1 requires law enforcement agencies to obtain a warrant before using drones for surveillance, with exceptions for search and rescue, amber alerts, and emergency situations. Virginia Code § 15.2-926.3 grants local governments authority to regulate drone takeoff and landing on public property, including parks, schools, and government buildings, but explicitly prohibits localities from regulating drone flight paths, navigation, or airspace — those remain under exclusive federal (FAA) jurisdiction under 49 USC § 40103. The Virginia Department of Aviation provides UAS guidance and encourages coordination with airport operators. All commercial drone operators must hold a valid FAA Part 107 Remote Pilot Certificate and register their aircraft with the FAA. LAANC authorization is available for controlled airspace around major Virginia airports including Dulles (IAD), Reagan National (DCA), Richmond (RIC), Norfolk (ORF), and others. Virginia state parks require a special use permit for commercial drone operations under DCR regulations. Military installations in Virginia — including Quantico Marine Corps Base, Fort Belvoir, Naval Station Norfolk, Joint Base Langley-Eustis, and Dahlgren — have restricted airspace and TFRs that require coordination with base operations and NOTAM checks.

Local Ordinances

Danville is an independent city in Virginia governed by Virginia state drone law (VA Code § 18.2-260.2 and § 15.2-926.3) and FAA Part 107 regulations. The City of Danville regulates drone takeoff and landing on public property under its municipal authority per § 15.2-926.3. Commercial drone operations in Danville city parks including Ballou Park, Anglers Park, and Dan Daniel Memorial Park require authorization from the Danville Parks and Recreation Department. The Riverwalk Trail along the Dan River requires a permit for commercial drone takeoff and landing on trail property. Pittsylvania County parks require a commercial use permit. Commercial drone filming for construction documentation, real estate marketing, or the Caesars Virginia casino development on private property requires property owner consent but no city film permit. FAA Part 107 Remote Pilot Certification is required for all commercial operations. LAANC authorization is required for flights within DAN Class D airspace boundaries. The Virginia Department of Aviation encourages all UAS operators to register their operations through the statewide UAS notification system.

Restricted Airspace

• Danville Regional Airport (DAN), located adjacent to the city, has Class D airspace with a 4 NM radius surface area from the surface up to 3,000 feet MSL. Eastern and northern portions of Danville fall within the DAN Class D lateral boundaries. The airport handles corporate jet, turboprop, and helicopter traffic serving local industry and the regional hospital. LAANC authorization is required and available for commercial drone operations within the DAN Class D area. Operators should check the FAA B4UFLY app for specific shelf boundaries at their flight location.
• Piedmont Triad International Airport (GSO), located approximately 45 NM south in Greensboro, NC, has Class C airspace with a 5 NM radius surface area and outer rings extending to 10 NM. The GSO Class C does not extend into Danville city limits but affects operators flying in southern Pittsylvania County toward the North Carolina border. LAANC authorization is required and available for commercial operations within GSO Class C boundaries. Operators should verify boundaries before flights in the southern part of the region.
• The Virginia National Guard has training facilities and operating areas in the Southside Virginia region that can generate temporary flight restrictions during military training exercises. Commercial drone operators working on construction or infrastructure projects in the Danville area should check NOTAMs for any military TFRs. The Guard facilities do not have permanent restricted airspace overlapping Danville but can activate temporary restrictions during training events.
• Danville is located on the Dan River, which flows through the city and creates a river corridor with moderate recreational traffic including kayakers, fishing boats, and occasional helicopter traffic related to medical transport and utility inspection. The Riverwalk Trail along the Dan River is heavily used by pedestrians and cyclists. Drone operators flying near the riverfront, Abittu Park, and the Danville Science Center should maintain Part 107 distance requirements from non-participants. The river corridor does not have designated airspace restrictions but safety considerations apply.
• The Virginia International Raceway (VIR), located approximately 25 NM east of Danville in Alton, hosts major motorsport events that can generate temporary flight restrictions for spectator events. Commercial drone operators working near the VIR area should check NOTAMs during major race weekends. The TFR for major motorsport events with large spectator attendance typically extends 3 NM from the venue. Operators in the eastern Pittsylvania County area should be aware of VIR event schedules.
