FAA Part 107 Requirements

State Drone Laws

Maryland regulates drone operations primarily through privacy statutes and a state-level UAS Task Force framework, while deferring airspace regulation to the FAA under 49 USC § 40103. Maryland Code § 3-703 prohibits using a drone to conduct visual surveillance of a private place without consent, classifying such acts as voyeurism — a misdemeanor carrying up to 1 year imprisonment and/or a $2,500 fine. HB 693 (2021) added data collection restrictions, requiring commercial drone operators to obtain consent before capturing images of identifiable individuals on private property. HB 128 (2015) established the Maryland UAS Task Force under § 4-1201 et seq, which coordinates state agency drone use and issues policy recommendations. Maryland is relatively permissive at the state level compared to other states — it does not require state drone registration and does not grant broad local government authority to restrict drone flights. However, the Maryland Park Service requires a special use permit for all commercial drone operations in state parks, and the Maryland Department of Natural Resources prohibits drone takeoff and landing in Natural Resources Management Areas without authorization. The critical airspace consideration in Maryland is the DC Flight Restricted Zone (FRZ), a 15-nautical-mile radius around Ronald Reagan Washington National Airport (DCA) where all drone flights are prohibited without specific FAA authorization — this affects the entire DC metro area including parts of Prince George's and Montgomery counties. Camp David (Naval Support Facility Thurmont) in Frederick County has Prohibited Area P-40, a permanent no-drone zone activated by NOTAM during presidential visits. Fort Meade, Fort Detrick, Aberdeen Proving Ground, and Naval Support Activity Bethesda have military airspace restrictions requiring coordination with base operations. LAANC authorization is available at BWI (Baltimore), IAD (Dulles), and other controlled airspace airports in Maryland. All commercial drone operators must hold a valid FAA Part 107 Remote Pilot Certificate and register their aircraft with the FAA.

Local Ordinances

Frederick is governed by Maryland state drone law (MD Code § 3-703 voyeurism prohibition and § 4-1201 UAS Task Force framework) and FAA Part 107 regulations. The City of Frederick does not have a specific municipal drone ordinance, meaning commercial drone operations on private property are governed by state law and FAA regulations. Frederick County Parks and Recreation requires a special use permit for commercial drone takeoff and landing in county parks including Ballenger Creek Park, Baker Park, and Catoctin Creek Park. Cunningham Falls State Park and Gambrill State Park require Maryland Park Service special use permits. Catoctin Mountain Park (National Park Service) prohibits all drone operations without a federal special use permit. Fort Detrick, located within city limits, requires coordination with Army base security for any drone operations near its perimeter — unauthorized overflight of the installation is prohibited. Camp David (Naval Support Facility Thurmont), approximately 10 NM northwest, has Prohibited Area P-40 that is activated by NOTAM during presidential visits, creating a 5-NM no-drone zone. Commercial drone operators should check NOTAMs before every flight in western Frederick County. The DC SFRA extends over all of Frederick County, requiring awareness of position relative to the FRZ boundary for operations in southern Frederick County near the Montgomery County line. FAA Part 107 Remote Pilot Certification is required for all commercial operations. LAANC authorization is available at FDK (Class E), IAD (Class B), and BWI (Class C). The Maryland Department of Transportation Aviation Administration encourages all UAS operators to register their operations and coordinate with airport managers.

Restricted Airspace

• Camp David (Naval Support Facility Thurmont), located approximately 10 NM northwest of downtown Frederick in the Catoctin Mountains, is protected by Prohibited Area P-40 — a permanent restricted airspace activated by NOTAM during presidential visits. P-40 creates a no-drone zone with a 5-nautical-mile radius extending from the surface up to 18,000 feet MSL when active. Commercial drone operators in western Frederick County and the Thurmont area must check NOTAMs before every flight, as P-40 can be activated with little notice. LAANC is not available within P-40 when active. This is one of the most sensitive restricted airspaces in the United States and violations are treated as national security incidents with potential federal prosecution and military interception.
• The Washington, DC Flight Restricted Zone (FRZ) is a 15-nautical-mile radius around Ronald Reagan Washington National Airport (DCA) where all drone flights are prohibited without specific FAA authorization through a separate waiver process. The FRZ boundary extends to approximately the Montgomery County line, roughly 20 NM south of Frederick. While downtown Frederick is outside the FRZ, the southern portions of Frederick County near Urbana and Clarksburg approach the FRZ boundary. Operators working in southern Frederick County should verify their position relative to the FRZ using the FAA B4UFLY app. The SFRA (Special Flight Rules Area) extends 30 NM from DCA and includes all of Frederick — drone operators within the SFRA must file a flight plan and operate below 18,000 feet, though commercial Part 107 operations are generally permitted within the SFRA outside the FRZ with LAANC authorization where applicable.
• Fort Detrick, located within the city of Frederick, is a U.S. Army medical research installation with restricted airspace and security zones. While Fort Detrick does not have a formal Class B/C/D airspace designation, the installation maintains a security buffer and requires coordination with base operations for any drone operations near its perimeter. The Army Garrison Fort Detrick prohibits unauthorized drone overflight of the installation and conducts research involving biological agents, making aerial surveillance particularly sensitive. Commercial operators working near the Fort Detrick campus on residential or commercial projects should maintain a safe standoff distance and coordinate with installation security if flight paths approach the base boundary.
• Washington Dulles International Airport (IAD) Class B airspace extends from the surface up to 10,000 feet MSL with multiple layered shelves. The northern Class B shelves reach into southern Frederick County, particularly affecting areas near Urbana, Clarksburg, and the I-270 corridor. LAANC authorization is required and available for commercial drone operations within the IAD Class B lateral boundaries. Operators should check the specific shelf altitude at their flight location — lower shelves may not affect typical Part 107 operations (which are limited to 400 feet AGL), but the surface-area portions around IAD require LAANC clearance.
• The Catoctin Mountain Park and Cunningham Falls State Park, located approximately 12 NM northwest of Frederick near Camp David, are federal and state parklands where commercial drone operations require permits. Catoctin Mountain Park is managed by the National Park Service, which prohibits all drone operations in NPS units without a special use permit issued by the park superintendent. Cunningham Falls State Park requires a Maryland Park Service special use permit for commercial drone takeoff and landing. The adjacent Catoctin Wildlife Preserve and Zoo also restricts drone overflight. These parks are in proximity to P-40 (Camp David), creating overlapping airspace restrictions that require careful NOTAM and permit verification before any commercial flights in the Catoctin Mountain area.
