FAA Part 107 Requirements

State Drone Laws

Virginia regulates drone operations through a combination of criminal surveillance statutes, local government authority provisions, and law enforcement warrant requirements. Virginia Code § 18.2-260.2 makes it a Class 1 misdemeanor to use a drone to trespass and conduct surveillance of another person without consent, capturing images or video of individuals in private settings. Virginia Code § 19.2-60.1 requires law enforcement agencies to obtain a warrant before using drones for surveillance, with exceptions for search and rescue, amber alerts, and emergency situations. Virginia Code § 15.2-926.3 grants local governments authority to regulate drone takeoff and landing on public property, including parks, schools, and government buildings, but explicitly prohibits localities from regulating drone flight paths, navigation, or airspace — those remain under exclusive federal (FAA) jurisdiction under 49 USC § 40103. The Virginia Department of Aviation provides UAS guidance and encourages coordination with airport operators. All commercial drone operators must hold a valid FAA Part 107 Remote Pilot Certificate and register their aircraft with the FAA. LAANC authorization is available for controlled airspace around major Virginia airports including Dulles (IAD), Reagan National (DCA), Richmond (RIC), Norfolk (ORF), and others. Virginia state parks require a special use permit for commercial drone operations under DCR regulations. Military installations in Virginia — including Quantico Marine Corps Base, Fort Belvoir, Naval Station Norfolk, Joint Base Langley-Eustis, and Dahlgren — have restricted airspace and TFRs that require coordination with base operations and NOTAM checks.

Local Ordinances

Fredericksburg is governed by Virginia state drone law (VA Code § 18.2-260.2 and § 15.2-926.3) and FAA Part 107 regulations. The City of Fredericksburg regulates drone takeoff and landing on public property under its municipal authority per § 15.2-926.3. Commercial drone operations in Fredericksburg city parks including Old Mill Park, Dixon Park, and Hurkamp Park require authorization from the Fredericksburg Parks and Recreation Department. The Rappahannock River Heritage Trail and the Virginia Central Rail Trail require permits for commercial drone takeoff and landing on trail property. Spotsylvania County and Stafford County parks require commercial use permits. Fredericksburg and Spotsylvania National Military Park, administered by the National Park Service, prohibits drone operations without a special use permit — this covers the extensive Civil War battlefield parks surrounding the city. Commercial drone filming for construction documentation or real estate marketing on private property requires property owner consent but no city film permit. FAA Part 107 Remote Pilot Certification is required for all commercial operations. LAANC authorization is required for flights within RIC Class C or IAD Class C airspace boundaries, though most of Fredericksburg is outside these areas. Operators flying north toward Stafford County should check SFRA and Quantico restricted airspace boundaries.

Restricted Airspace

• Fredericksburg sits between two major controlled airspace areas. To the north, the Washington DC Special Flight Rules Area (SFRA) extends 30 NM from Reagan National Airport (DCA). Fredericksburg is approximately 50 NM from DCA, placing it outside the SFRA. However, operators flying north toward Stafford County and Quantico should be aware that the SFRA outer ring begins approximately 25 NM north of Fredericksburg. The SFRA has specific transponder and flight plan requirements for all aircraft including drones, and the inner 15 NM Flight Restricted Zone (FRZ) prohibits most drone operations entirely.
• Quantico Marine Corps Base is located approximately 20 NM north of Fredericksburg along the I-95 corridor. The base has restricted airspace (R-4009 A/B/C) and military operating areas that affect the Stafford County area. Commercial drone operators working on construction projects in northern Stafford County should check NOTAMs for Quantico TFRs during military training exercises, VIP movements, or artillery firing. The Quantico airspace does not extend into Fredericksburg city limits but affects nearby northern growth corridors.
• Shannon Airport (EZF), located approximately 5 NM east of Fredericksburg in Spotsylvania County, is an uncontrolled GA airport with Class E airspace. While Class E does not require LAANC authorization for drone operations, operators should maintain awareness of small aircraft traffic in the vicinity. Shannon Airport handles light GA traffic including training flights and recreational aircraft. Operators flying in the Spotsylvania County area near the airport should exercise caution and monitor the common traffic advisory frequency.
• The Rappahannock River corridor through Fredericksburg has moderate recreational traffic including kayakers, fishing boats, and occasional helicopter traffic. The Virginia Central Rail Trail and the Rappahannock River Heritage Trail are heavily used by pedestrians and cyclists. Drone operators flying near the riverfront, Old Mill Park, and the canal path should maintain Part 107 distance requirements from non-participants. The river corridor does not have designated airspace restrictions but safety considerations apply for recreational traffic.
• Naval Support Activity Dahlgren, located approximately 25 NM southeast of Fredericksburg in King George County, has restricted airspace and military testing ranges. While the Dahlgren restricted airspace does not extend to Fredericksburg, operators traveling to construction projects in the Dahlgren area should coordinate with base operations. The base conducts weapons testing and research that may create temporary flight restrictions. Operators in eastern Stafford County should check NOTAMs for Dahlgren-related TFRs.
