FAA Part 107 Requirements

State Drone Laws

Illinois regulates commercial drone operations primarily through the Drones Omnibus Act (720 ILCS 5/48-1 through 48-5), enacted as Public Act 99-0566 and effective January 1, 2017. The Act prohibits using drones for surveillance of individuals without consent, restricts law enforcement drone use without a warrant, and bans drone harassment. Commercial drone operators in Illinois must hold a valid FAA Part 107 Remote Pilot Certificate and comply with all federal regulations including LAANC authorization for controlled airspace. Illinois does not require a separate state-level drone license or registration beyond FAA requirements. The Illinois Department of Transportation (IDOT) Division of Aeronautics provides regulatory guidance and coordinates with the FAA on airspace matters. Illinois has state preemption language limiting local municipalities from enacting drone regulations that conflict with state or federal law, though Chicago maintains its own drone ordinance under the Chicago Municipal Code (10-36-070) requiring registration with the city for commercial operations within city limits. Operators near military installations (Naval Station Great Lakes, Scott Air Force Base, Rock Island Arsenal) must coordinate with base operations and check for active TFRs. The FAA controls all airspace above 400 feet AGL. The Chicago metropolitan area has extensive Class B (O'Hare) and Class C (Midway) airspace requiring LAANC authorization for most urban drone operations.

Local Ordinances

The City of Waukegan does not have a specific municipal drone ordinance beyond Illinois state law, but commercial drone operators conducting business within city limits must hold a valid City of Waukegan business license. Drone takeoff and landing in city parks requires coordination with the Waukegan Park District. Operations near Waukegan National Airport (UGN) require LAANC authorization through the FAA. Restricted Airspace

• Class D: Waukegan National Airport (UGN / KUGN) Surface Area. Waukegan National Airport has Class D airspace extending approximately 4.4 NM from the airport up to 3,000 ft AGL. This covers most of Waukegan including the lakefront, downtown district, and industrial corridor. KUGN is one of the busiest general aviation airports in the Chicago metro area with significant corporate jet traffic. Commercial drone operators within this airspace must obtain LAANC authorization before flight. The airport serves manufacturers, corporate fleets, and recreational pilots throughout the Lake County region.
• Infrastructure: Lake Michigan Shoreline and Waukegan Harbor. The Waukegan lakefront and harbor represent critical infrastructure with ongoing environmental remediation, pier inspection, and waterfront redevelopment projects. The harbor is one of the largest marina facilities on the Illinois Lake Michigan shoreline. Drone operations over the lake and harbor area should coordinate with the Waukegan Port Authority and follow FAA guidance for operations over water. The former Waukegan coal plant site is undergoing environmental remediation and brownfield redevelopment requiring aerial monitoring.
• Infrastructure: I-94 Tri-State Tollway and U.S. Route 41 Corridor. The I-94 Tri-State Tollway and U.S. Route 41 are major transportation corridors through Waukegan with continuous bridge, interchange, and widening projects managed by ISTHA and IDOT. Drone operations near highway bridges and interchanges should coordinate with transportation authorities and follow FAA guidance for critical infrastructure inspection. The North Chicago border and Naval Station Great Lakes proximity creates additional airspace considerations.
• Military: Naval Station Great Lakes Proximity. Naval Station Great Lakes, located immediately south of Waukegan in North Chicago, is the U.S. Navy's largest training installation. The base can generate temporary flight restrictions (TFRs) that may affect drone operations in southern Waukegan. Operators should check for active TFRs via the FAA TFR database before any mission near the base boundary. The base also creates demand for infrastructure aerial imaging on surrounding federal and contractor facilities.
