FAA Part 107 Requirements

State Drone Laws

Delaware regulates drone operations through the Delaware Drone Privacy Protection Act (HB 340, 2016) and UAS framework regulations under Delaware Code Title 21 § 4601 et seq, while deferring airspace regulation to the FAA under 49 USC § 40103. HB 340 prohibits using a drone to conduct surveillance of a private dwelling or person without consent, classifying violations as a Class A misdemeanor with up to 1 year imprisonment and/or a $2,300 fine. SB 162 (2019) established law enforcement UAS use guidelines, requiring warrants for drone surveillance and creating a state UAS registry for public agency drone operations. Delaware is relatively permissive for commercial Part 107 operators — the state does not require separate state drone registration for commercial flights and does not broadly preempt local zoning or park restrictions. The Delaware Department of Transportation (DelDOT) has adopted an internal UAS policy for infrastructure inspection and permits coordination. Delaware State Parks require a special use permit for commercial drone takeoff and landing in all state parks including Cape Henlopen, Delaware Seashore, Lums Pond, Brandywine Creek, and Trap Pond. The Delaware National Guard operates drone training at the Bethany Beach Training Site near the coast, which has intermittent TFR airspace restrictions. Delaware has no Class B airspace — the state is under the Class C shelf of Philadelphia International Airport (PHL) in northern New Castle County and under Class E surface areas and Class D airspace near Dover Air Force Base (DOV) in central Kent County. Dover AFB has active military airspace with LAANC coordination required for nearby commercial flights. The FAA requires Part 107 Remote Pilot Certification for all commercial drone operations. LAANC authorization is available at PHL (Class C), DOV (Class D), and surrounding Class E surface areas. The Delaware Department of Natural Resources and Environmental Control (DNREC) prohibits drone takeoff and landing in state-protected natural areas and wildlife refuges without authorization, including Prime Hook and Bombay Hook National Wildlife Refuges.

Local Ordinances

Middletown is governed by Delaware state drone law (DE Code Title 21 § 4601 et seq, HB 340 Drone Privacy Protection Act) and FAA Part 107 regulations. The Town of Middletown does not have a specific municipal drone ordinance, meaning commercial drone operations on private property are governed by state law and FAA regulations. The Delaware Air National Guard operates from New Castle County Airport (ILG) approximately 18 NM north, and military drone operations at the facility may trigger temporary airspace restrictions. Dover Air Force Base (DOV), approximately 25 NM south, maintains active military airspace with counter-UAS measures — commercial operators in southern New Castle County should verify NOTAMs before every flight. FAA Part 107 Remote Pilot Certification is required for all commercial operations. LAANC authorization is available at PHL (Class C), ILG (Class D), DOV (Class D), and N14 (Class E surface area). The Delaware Department of Transportation (DelDOT) has adopted an internal UAS policy for infrastructure inspection of state highways including SR 1 and the new US 301 expressway, and coordinates with commercial drone operators for highway corridor aerial imaging projects.

Restricted Airspace

• Dover Air Force Base (DOV) Class D airspace extends from the surface up to 3,800 feet MSL in a 5-nautical-mile radius, approximately 25 NM south of Middletown. DOV is an active military airlift base operating C-5M Super Galaxy and C-17 Globemaster III aircraft — heavy military transport planes with unpredictable flight patterns during launch and recovery. LAANC authorization is required for commercial drone operations within the Class D lateral boundaries. The base has a heightened security posture with active counter-UAS measures and patrols, making unauthorized drone overflight particularly dangerous and subject to immediate military response. Commercial operators working in southern New Castle County near Middletown should check NOTAMs for DOV and verify their position relative to the Class D boundary using the FAA B4UFLY app.
• The northern portions of New Castle County, approximately 25 NM north of Middletown, fall within the outer Class C shelves of Philadelphia International Airport (PHL). While Middletown proper sits below the Class C surface area, commercial drone operators working in northern New Castle County near Bear and Wilmington should be aware of PHL Class C airspace that extends from 2,100 to 5,000 feet MSL in the outer rings. The surface-area Class C extends 10 NM from PHL and does not reach Middletown, but operators flying above 400 feet AGL in northern Delaware should verify airspace class. LAANC authorization is required and available within PHL Class C shelves.
• New Castle County Airport (ILG) Class D airspace, approximately 18 NM north of Middletown, creates a controlled airspace zone from the surface up to 3,200 feet MSL in a 4.5-NM radius. The airport is the primary civil aviation facility in Delaware with significant business jet and charter traffic. LAANC authorization is required for commercial drone operations within the ILG Class D boundaries. Operators working in the Wilmington-New Castle area should coordinate with ILG tower via LAANC. The airspace between Middletown and ILG is generally Class E (surface to 700 AGL in the airport vicinity, Class E above 14,500 feet elsewhere), where LAANC is available but not always mandatory for Part 107 operations at 400 feet AGL.
• Summit Airport (N14), approximately 8 NM north of Middletown near the town of Middletown- Townsend area, operates in Class E airspace with a surface area designation. N14 is a busy general aviation airport serving the central Delaware aviation community with flight training, charter, and private operations. While Class E surface areas do not require LAANC for Part 107 operations at or below 400 feet AGL, commercial operators should be aware of traffic patterns and coordinate with the airport when operating nearby. The FAA recommends filing a drone flight plan and contacting the airport for operations within 3 NM of any airport.
• The Delaware National Guard Training Site at Bethany Beach, approximately 60 NM south of Middletown, has intermittent Temporary Flight Restrictions (TFRs) during military drone training exercises including MQ-9 Reaper operations. While distant from Middletown, commercial operators working anywhere in Delaware should check active NOTAMs before flying, as these TFRs can be activated with little notice. The Delaware Bay coastal area south of Dover also has seasonal wildlife TFRs protecting migratory bird populations during spring and fall migrations. DNREC prohibits drone takeoff and landing in the Bombay Hook and Prime Hook National Wildlife Refuges, both approximately 35 NM south of Middletown, without federal authorization.
