FAA Part 107 Requirements

State Drone Laws

New Hampshire regulates drone operations primarily through RSA 207:37-39, enacted in 2015 and amended in subsequent sessions. RSA 207:37 prohibits the use of unmanned aerial vehicles for surveillance of private property without consent and restricts drone operations over correctional facilities, power plants, and other critical infrastructure. RSA 207:38 prohibits weaponizing drones and restricts drone use by law enforcement without a warrant, except in emergency situations. RSA 207:39 addresses privacy concerns, making it unlawful to use a drone to capture images of individuals in private settings without consent. New Hampshire does not require a separate state-level commercial drone license or registration — all commercial operators must hold a valid FAA Part 107 Remote Pilot Certificate and register their aircraft with the FAA. The state follows FAA Part 107 preemption on airspace regulation, meaning municipalities cannot enact their own airspace rules but may regulate takeoff and landing on public property. The New Hampshire Division of Parks and Recreation prohibits drone takeoff and landing in all state parks without a special use permit. NH Fish and Game restricts drone operations in wildlife management areas during nesting and breeding seasons. The FAA controls all airspace above 400 feet AGL and LAANC authorization is available for Class B, C, and D airspace across New Hampshire, including Manchester-Boston Regional Airport (MHT) Class C and Portland International Jetport (PWM) Class C in adjacent Maine. Commercial operators near Pease Air National Guard Base (Portsmouth) and the Portsmouth Naval Shipyard must coordinate with base operations and check NOTAMs.

Local Ordinances

Nashua is governed by New Hampshire state drone regulations (RSA 207:37-39) and FAA Part 107. The City of Nashua does not have a specific municipal drone ordinance as of 2026, but commercial drone takeoff and landing on city-owned property requires authorization from the Nashua Parks and Recreation Department. Nashua city parks including Mine Falls Park, Greeley Park, Roby Park, and Lyons Park require explicit permission for commercial drone operations. The Nashua River corridor and Mine Falls Park are regulated by the Nashua Planning Department for commercial drone filming. Commercial drone filming for movies, TV, or advertising requires coordination with the New Hampshire Film Bureau and Nashua Police Department. FAA Part 107 Remote Pilot Certification is required for all commercial operations. LAANC authorization is required for flights within the ASH Class D airspace boundary and the MHT Class C outer area. Rivier University and Nashua Community College campuses require coordination with facilities management for drone operations on campus grounds.

Restricted Airspace

• Nashua Airport / Boire Field (ASH) has Class D airspace with a 4.4 NM radius surface area from the surface up to 2,500 feet MSL. ASH is located just 3 miles north of downtown Nashua, meaning central and northern Nashua fall within the ASH Class D boundary. Commercial drone operators must obtain LAANC authorization before flying within the ASH Class D area. ASH is the busiest GA airport in New Hampshire with significant corporate, training, and charter traffic. Operators should check FAA B4UFLY for exact boundaries and NOTAMs before every flight.
• Manchester-Boston Regional Airport (MHT) Class C airspace extends 5 NM from the airport surface area up to 4,000 feet AGL, with an outer area from 10-20 NM up to 10,000 feet. MHT is 12 NM north of Nashua, so northern Nashua and the Everett Turnpike corridor approach the MHT Class C outer area. Operators flying north of Nashua along the US-3 / Everett Turnpike corridor should verify MHT Class C boundaries using FAA B4UFLY and obtain LAANC authorization if within the Class C surface area.
• Boston Logan International Airport (BOS) Class B airspace outer shelf extends into southern New Hampshire near the Massachusetts border. The BOS Class B outer shelf reaches 7,000 feet AGL over the Salem, NH area approximately 20 NM southeast of Nashua. While Nashua city center is outside the BOS Class B lateral boundaries, operators flying in southern Hillsborough County near the MA border should be aware of BOS Class B traffic patterns and check FAA B4UFLY for exact altitude shelves.
• The Nashua River corridor and Mine Falls Park are popular for commercial drone photography, but operators must maintain visual line of sight and comply with FAA Part 107.39 regarding operations over people and moving vehicles. Mine Falls Park has active pedestrian, bicycle, and recreational traffic. The Nashua River Rail Trail and Heritage Rail Trail corridors have similar traffic considerations. Commercial drone takeoff and landing on city-owned property requires authorization from the Nashua Parks and Recreation Department.
• Helicopter traffic in the Nashua area includes Dartmouth-Hitchcock Medical Center medevac flights (Dartmouth-Hitchcock Advanced Response Team), New Hampshire State Police helicopter operations, and news helicopters from Boston media outlets. The US-3 / Everett Turnpike corridor and NH-101A have active medevac helicopter routes. St. Joseph Hospital and Southern New Hampshire Medical Center in Nashua receive medevac flights. Drone operators should maintain situational awareness of low-altitude helicopter traffic per FAA Part 107.39.
