FAA Part 107 Requirements

All commercial drone operations in Montana require the pilot to hold an active FAA Part 107 Remote Pilot Certificate. Our network operators are verified Part 107 holders.

State Drone Laws

Montana does not have comprehensive state-level drone legislation. Commercial drone operators must hold a valid FAA Part 107 Remote Pilot Certificate and comply with all federal regulations. Montana Code Annotated § 60-1-101 defines aircraft as including drones, subjecting them to state aviation regulations where applicable, but the Montana Aeronautics Division defers to FAA authority for commercial drone operations under Part 107. Montana Code § 2-15-3106 gives the Department of Transportation authority over aviation safety, but no specific drone permitting or registration requirement exists at the state level beyond FAA registration. Local municipalities may regulate takeoff and landing on public property. Montana Fish, Wildlife & Parks requires permits for drone operations in state parks. Operators should check for local city and county ordinances regarding park usage and public property restrictions.

Local Ordinances

Whitefish does not have a comprehensive city-specific drone ordinance, relying on FAA Part 107 regulations and Montana state law. Commercial drone operators must hold a valid FAA Part 107 Remote Pilot Certificate. The Whitefish Parks and Recreation Department requires authorization for commercial drone takeoff and landing on city-owned park property, including Whitefish City Beach, Riverside Park, and the Whitefish Trail system. Operations near Glacier Park International Airport (FCA) require LAANC authorization within the Class D surface area. Glacier National Park prohibits all drone operations under NPS regulations (36 CFR 1.5). Whitefish Mountain Resort requires authorization for commercial drone operations on ski area property. Montana Fish, Wildlife & Parks requires permits for drone operations in state parks, including Whitefish Lake State Park and Les Mason State Park. The BNSF Railway prohibits drone operations over the Whitefish rail yard without written authorization. Montana Code Annotated § 60-1-101 includes drones in the definition of aircraft, but the state defers to FAA authority for Part 107 commercial operations.

Restricted Airspace

• Glacier Park International Airport (FCA) has Class D airspace extending from the surface to 7,300 feet MSL within 4 nautical miles of the airport. While Whitefish is 15 miles north of FCA, portions of the southern Whitefish area near Big Mountain and the Whitefish Lake south shore may fall within the FCA Class D outer area. LAANC authorization is required for commercial drone operations within the FCA Class D surface area. Use the FAA B4UFLY app or approved LAANC providers (Aloft, AirMap) for authorization before flying within 4 NM of FCA. FCA handles approximately 400,000 passengers annually with commercial service from United, Delta, Alaska, and Allegiant, primarily serving Glacier National Park tourism.
• Whitefish Mountain Resort (Big Mountain) is a major ski area and summer recreation destination that creates complex drone operational considerations. The resort operates on US Forest Service leased land through the Flathead National Forest. Commercial drone operations on ski area property require authorization from Whitefish Mountain Resort management and may require additional US Forest Service permits. The ski area has summer mountain biking, zip line, and scenic lift operations with heavy visitor traffic. FAA Part 107 prohibits flying directly over non-participants, and the resort has restricted areas near lift towers, mountain bike trails, and the summit visitor complex. The mountain elevation (6,817 feet at the summit) creates density altitude effects on drone performance. Commercial real estate and construction aerial imaging work near the base area should coordinate with resort management.
• Glacier National Park, located 25 miles northeast of Whitefish, is a strict no-drone zone. The National Park Service prohibits drone operations over all NPS-administered lands under 36 CFR 1.5 and NPS Policy Memorandum 14-05. The Going-to-the-Sun Road corridor, Lake McDonald, and all park trails and backcountry areas are off-limits to drones. Commercial drone operators based in Whitefish should be aware that many clients may request aerial photography of Glacier National Park — these requests cannot be fulfilled legally. The park boundary is close enough to Whitefish that drone operators should carefully verify their position relative to the park boundary when flying in the North Fork and Apgar areas. Violations can result in federal citations and fines up to $5,000.
• Whitefish Lake is a popular recreational lake with heavy boat, swimmer, and angler traffic during summer. FAA Part 107 prohibits flying directly over non-participants. The Whitefish City Beach, Les Mason State Park, and the Whitefish Lake Lodge area have especially high pedestrian density during summer tourism season. Drone operators conducting real estate photography of lakefront properties should plan flights for early morning when beach and lake traffic is minimal. The Whitefish Lake State Park requires a Montana Fish, Wildlife & Parks permit for commercial drone takeoff and landing on park property. The lake is also within the approach corridor for FCA — check airspace charts for your specific location.
• The BNSF Railway corridor runs through the center of Whitefish along the historic Great Northern Railway route. The Whitefish Amtrak depot is a major stop on the Empire Builder route, and the BNSF rail yard has classification and maintenance facilities. Drone operations over or near railroad infrastructure are restricted under FAA Part 107 and railroad safety regulations. Drone operators should maintain minimum 500-foot lateral distance from rail yard infrastructure and never fly directly over moving trains, switching operations, or maintenance activities. The BNSF Railway prohibits drone operations over rail yard infrastructure without written authorization. The rail corridor divides the city — plan flight paths to avoid the rail corridor when possible.
